Recent cases have highlighted the risks of the two roles being conflated and, in particular, allegations of Principals and other ‘contracting’ parties engaging in conduct which calls into question the Superintendent’s independence.

Content

Superintendents are generally engaged by a Principal or other ‘contracting’ party to perform dual roles in service of their obligation to administer a construction contract:

  1. The Superintendent acts as the agent of the Principal or ‘contracting’ party; and

  2. The Superintendent performs independent certification functions, for example, valuing claims.

Matt Bradbury, Partner

Matt has practised in both Australia and the United Kingdom. He is an infrastructure, construction and engineering lawyer who has advised on civil, building, mechanical, mining and structural projects in each state and territory of Australia and throughout South East Asia. Matt advises on all aspects of construction, infrastructure and major engineering projects where he works side by side with his clients and their external consultants to successfully deliver their projects. Matt’s technical knowledge and experience has resulted in him being regularly engaged as a speaker on construction law for both client workshops and industry conferences. Matt is also a guest lecturer at The University of Queensland in the Engineering Faculty.


Lisa Myers, Senior Associate

Lisa is an experienced building and construction disputes Senior Associate with extensive expertise in large and complex litigation involving major infrastructure projects across the Eastern seaboard.

Lisa acts for principals, contractors, subcontractors and design consultants on private and public sector projects of all sizes.

She acts in partnership with clients at all stages of the project life cycle from tender through to close out of project claims and disputes. In the event that a dispute cannot be resolved at a commercial level, Lisa acts for clients in a range of dispute resolution forums including Security of Payment adjudications, mediation, arbitration, and court proceedings.
