A deep dive into the intricacies and challenges of construction contracts, involving high dollar values.

IPWEA-QNT in conjunction with Legaleze Training, is offering a detailed and engaging 4.5 hour session to build your knowledge of building, construction, civil and infrastructure contracts. Delivered by practicing lawyers, we cover the whole range of issues from contract negotiation, risk management, managing contracts and performance and how the contract assists project delivery. Attendees wil build their knowledge of construction law and gain a contemporaneous look into current issue and practice when dealing with construction contracts.

Content

This 4-5 hour workshop on Construction Contracts will provide a practical overview of the following:

  • Contract negotiation, set up and departures (against a business risk propensity)

  • Key Risk Clauses:

  •  Latent conditions; extensions of time; variations; payment; defects; delay; security; practical completion; insurance; indemnity.

  • Fundamental breach, non-performance and termination.

  • Managing performance

  • The various forms of contracts: lump sum; alliance; consulting; schedule of rates.

  • Current case law in construction contracts

  • What issues do you face? (and open forum discussion)

This will assist leaders, aspiring leaders and those with experience to build a more detailed knowledge of these more demanding contracts.

Legaleze

Sean McCarthy

Sean is the Director of Legaleze and Legaleze Training which is both a legal practice and dedicated contract training company. He has been practicing construction and commercial law for many years working for both Government and the private sector. His primary focus is on “front end” construction law assisting clients reviewing, negotiating and drafting contracts. He is also involved with many clients assisting with day to day contract management around claims and disputes. As well as his passion for the law, he is a passionate educator having been training on contracts, contract management and associated areas since 2010.


Marg Andre

Marg Andres is both a qualified lawyer and qualified adult education specialist. She has worked with Sean McCarthy in Legaleze and Legaleze Training since 2016 particularly focussing on matters in formal dispute, their early resolution and teaching at all levels of the building and construction industry. Marg brings an enthusiastic and participative approach to training.
